We all know the left has a poor understanding of the U.S. Constitution, but perhaps the most misunderstood section is the Second Amendment.
Joy “Joyless” Behar of the “The View” fell under the category of the poorly informed when she said that “once black people get guns in this country, the gun laws will change.”
BlazeTV host Pat Gray of “Pat Gray Unleashed” pointed out that no law prohibits Black Americans from owning firearms. And, despite what Behar seems to think, black Americans not only have a constitutional right to own guns, they exercise that right every day.
The Second Amendment states: “A well-regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
So let’s break this down.
What is a well-regulated militia? It is a military force raised from the civil population to supplement a regular army in an emergency. This means rogue militias cannot rise up vigilante-style for reasons that are not considered a public emergency.
Who are “the people”? In legal terms, “the people” means a nation in its collective and political capacity.
What does “shall not be infringed” mean? The government cannot infringe upon, in a way, that which violates the law or the rights of another. We often hear the term used in the context of copyright infringement, a legal matter that deals with protecting an individual’s intellectual property.
Everyone who is not racist already knows this. And whether Behar misspoke or not, she might consider walking back her offensive comment.
